The Land Down Under should be renamed the Land that Rocks, and it\u2019s not just because Aussies gave us Fosters, Crocodile Dundee, and a bevy of other wonderful contributions. For several years now, the country that\u2019s also a continent has been a global leader in the war against spam, even making contributions to spam filter research through the <a href=\"http:\/\/www.allspammedup.com\/2013\/08\/game-on-australian-researchers-think-spam-filters-can-learn-from-game-theory\/\">use of game theory<\/a>, and on the legislative side, Australia became a pioneer in the war against spam when it passed the <a href=\"http:\/\/www.acma.gov.au\/webwr\/consumer_info\/frequently_asked_questions\/spam_business_practical_guide.pdf\">Spam Act 2003<\/a>.<!--more--><\/p>\n<p>And rather than just rest on its laurels for passing the act, the country\u2019s actually doing something about it. Handing down fines has become something of a routine procedure , with many examples of how the country just isn\u2019t going to take the crap that spammers like to spew. The Australian Communications and Media Authority (ACMA) is the watchdog and enforcer for the Act, and it isn\u2019t easing up on those who insist on bugging others through electronic means. Instead, it\u2019s got its foot on the spammers\u2019 throats and it\u2019s not letting up. Here are a few examples of Australia\u2019s awesomeness:<\/p>\n<ul>\n<li>In 2009, <a href=\"http:\/\/www.smh.com.au\/technology\/biz-tech\/campaign-fizzer-vodafone-cops-110k-fine-for-coke-sms-ad-20091110-i6vv.html\">Vodafone was fined $110,000 (AUD)<\/a> and Coca-Cola received a formal warning for an SMS spamming campaign<\/li>\n<li>In 2009, <a href=\"http:\/\/www.arnnet.com.au\/article\/273082\/acma_hits_optus_110_000_fine_spam_act_breach\/\">telco Optus<\/a> got a wakeup call of $110,000 (AUD) for hitting people with the very same thing it was supposed to protect against<\/li>\n<li>In 2009, <a href=\"http:\/\/www.brisbanetimes.com.au\/technology\/spam-mastermind-fined-210000-20091222-lb7f.html\">spam \u2018mastermind\u2019 Lance Atkinson<\/a> was fined $210,000 (AUD) and ordered to keep his spam-happy fingers away from keyboards for 7 years<\/li>\n<li>In 2012, <a href=\"http:\/\/www.straitstimes.com\/breaking-news\/singapore\/story\/australia-fines-tiger-airways-spamming-20121026\">Tiger Airways had its whiskers clipped<\/a> with a $110,000 fine (AUD) for flying in the face of the Spam Act 2003<\/li>\n<li>This year, <a href=\"http:\/\/www.smartcompany.com.au\/advertising-and-marketing\/055772-cellarmaster-wines-slammed-with-110-000-fine-for-violating-spam-act.html\">Cellarmaster Wines was hit<\/a> with a $110,000 fine (AUD) for making spam instead of wine<\/li>\n<\/ul>\n<p>And the list goes on. Its enforcement of the Act allows ACMA to apply fines up to $220,000 (AUD), but it can also take companies and individuals to court, ACMA has achieved court rulings for more than <a href=\"http:\/\/www.virusbtn.com\/news\/2006\/10_27_spam.xml?mobile_on=yes\">$5 million (AUD)<\/a> against Perth-based Clarity1, <a href=\"http:\/\/www.abc.net.au\/news\/2009-10-24\/would-be-spammers-given-16m-warning\/1115558\">$16 million (AUD) in 2009<\/a> against two companies and three individuals, and <a href=\"http:\/\/archive.acma.gov.au\/WEB\/STANDARD\/pc=PC_312374\">$24.25 million against 8 individuals<\/a> in 2010.Not wanting to take that foot off the accelerator, the most recent spam fine is a whopping $165,000 (AUD), levied this week against GraysOnline, a set of shopping sites that reportedly sent hundreds of thousands of spam emails that directly violated the Spam Act 2003. The fine is a record, being the largest ever for which ACMA\u2019s directly (i.e., without court intervention) penalized a company, and according to <a href=\"http:\/\/www.smh.com.au\/digital-life\/digital-life-news\/graysonline-fined-record-165000-for-spam-20131009-2v78c.html\">The Sydney Morning Herald<\/a>, it\u2019s also the 26<sup>th<\/sup> time that ACMA has fined a company under the Act.<\/p>\n<p>According to the SMH, \u201cJulia Cornwell McKean, manager of the ACMA&#8217;s Unsolicited Communications and Compliance section, said GraysOnline sent the email without an &#8220;unsubscribe&#8221; link to 700,000 Australians. Further, about 300,000&nbsp;were sent to people who had previously withdrawn consent from receiving&nbsp;Grays emails,&nbsp;McKean said.\u201d<\/p>\n<p>When it comes to the oft-frustrating war against spam, both <a href=\"http:\/\/www.allspammedup.com\/2013\/10\/holiday-creeps-uhm-creep-approaching-fast\/\">legitimate<\/a> and <a href=\"http:\/\/www.allspammedup.com\/2013\/04\/spam-more-dangerous-than-ever\/\">illegitimate<\/a>, this is just about as awe-inspiring as it gets. While other countries (we\u2019re looking at you, <a href=\"http:\/\/www.allspammedup.com\/2013\/07\/killing-a-good-idea-or-why-canada-sucks\/\">Canada<\/a>) just pretend that they\u2019re actually doing something about spam, Australia is setting the example for how this bad behavior should be treated. Per the SMH, \u201cAccording to the ACMA, the Spam Act requires that all marketing emails are sent with the consent of the recipient, and include an option for recipients to opt-out of receiving further marketing messages.\u201d And this is an important point, because marketers are the <a href=\"http:\/\/www.allspammedup.com\/2013\/05\/when-spam-comes-knocking-if-spam-could-talk\/\">equivalent of used car salesmen<\/a>, programmed to do <a href=\"http:\/\/www.allspammedup.com\/2013\/01\/email-marketing-spam-the-new-villain-in-2013\/\">whatever it takes<\/a> to get you in that car. For every \u2018real\u2019 email (i.e., the ones you actually want), there are a dozen that are just dying to <a href=\"http:\/\/www.allspammedup.com\/2013\/01\/why-marketing-spammers-should-be-deported\/\">bypass your spam filter<\/a>, as if bypassing your spam filter is some kind of magic recipe for a sale. They go out of their way to circumvent, even providing <a href=\"http:\/\/venturevillage.eu\/dodge-the-spam-folder\">lessons<\/a> on <a href=\"http:\/\/www.business2community.com\/online-marketing\/eight-simple-rules-to-evade-the-spam-folder-0377015\">how to<\/a> circumvent.&nbsp; Yet they seem to ignore <a href=\"http:\/\/www.allspammedup.com\/2012\/12\/70-of-spam-complaints-caused-by-email-marketers\/\">the fact that all they\u2019re doing is ticking off those who simply don\u2019t want it<\/a>. That\u2019s why we have spam filters, for crying out loud.<\/p>\n<p>Nevertheless, Australia\u2019s got it figured out, and other countries should take note. \u201c\u2019This case demonstrates the domino effect one wrong decision can have,\u2019 said ACMA deputy chairman Richard Bean. \u2018Businesses take a huge risk if they decide an email doesn&#8217;t need to comply with the Spam Act.\u2019\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>How can you not love Australia?
